Terms of Service

These Terms of Service ("Terms") govern your access to and use of the JobPics website and app (together, the "Service"), operated by an individual sole proprietor based in Missouri, United States ("JobPics," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use JobPics

You must be at least 18 years old and able to form a binding contract to use JobPics. You're responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

2. The Service

JobPics helps solo service professionals log before/after job photos, organize them by client and date, and share them with clients. The Service is provided on an "as is" and "as available" basis, and features may change, be added, or be removed over time. JobPics is currently in active development and offered without warranty of uninterrupted availability.

3. Your content

You retain all ownership rights to the photos, client information, and other content you upload to JobPics ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive license to host, store, and display it back to you solely for the purpose of operating the Service. We do not claim ownership of Your Content and will not use it for advertising without your consent.

You're solely responsible for Your Content and for having the necessary rights and permissions — including any consent required from clients or third parties depicted in photos — to upload and use it through the Service.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or to violate any third party's rights;
• Upload content that is harassing, defamatory, or otherwise inappropriate;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Interfere with or disrupt the integrity or performance of the Service;
• Reverse-engineer or resell the Service without our written permission.

5. Fees and plans

JobPics may offer free and paid plans. If we introduce paid plans, pricing, billing terms, and cancellation policies will be presented at the time of purchase and are incorporated into these Terms by reference. Any waitlist signup or current free access does not guarantee continued free access.

6. Termination

You may stop using the Service and delete your account at any time from the Account page or by contacting us. We may suspend or terminate your access if you violate these Terms, or if we discontinue the Service, with notice where reasonably possible.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBPICS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

9. Governing law

These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Missouri, and you consent to their jurisdiction.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you directly. Continued use of the Service after changes take effect means you accept the updated Terms.
